Huttoft Car Terrace Pervert

Lincolnshire County Council (LCC) are once again paying a local security firm to intimidate law abiding citizens parking overnight at Huttoft Car Terrace.

Last night the security firm caused a lady considerable distress at 03.10 by looking through every window shining a bright torch. The lady was in her nightwear. Fortunately this disgraceful event was witnessed by Alex Sprott who saw off the pervert.

I have taken his up with LCC and recommended that the lady refers the criminal offence to the Police.

As the lady had not left her vehicle she was conducting herself lawfully. Indeed it is LCC who breached Part 4 – 7 (2) of the byelaw. By intimidating the lady.

I request that you look into this disgraceful incident as a matter of urgency. It is inappropriate for LCC to employ a pervert who enjoys spying on ladies in their nightwear.

No Motor Caravan Signs Still Visable

Despite assurances from North Yorkshire County Council (NYCC) that:

the Highways department are instructing the Contractor to cover up the signs until the TRO is implemented.”

Last Friday the signs where still not covered on West Cliff, Whitby.

Victory – No Motor Caravans Signs

I am delighted to announce that my complaint against North Yorkshire County Council that the No Motor Caravan signs should be removed has in effect being successful as:

“the Highways department are instructing the Contractor to cover up the signs until the TRO is implemented.”

In addition the earliest the new order would be introduced is August 21st. Enjoy parking overnight in Whitby and Scarborough until the 21st August at the earliest.

Whitby Gazette Breach Editors Code

Whitby Gazette have breached the Editors Code of Practise with their article County council to clamp down on motorhomes.

  • Areas being targeted under the new ban will be Whitby’s North Promenade, Love Lane, North Terrace, Church Street and Royal Crescent; the Royal Albert Drive, Foreshore Road, Sandside and Esplanade at Scarborough; The Beach, Crescent Hill and The Crescent at Filey; Sandsend Road and Lythe Bank, Sandsend; and Filey Road, Osgodby Hill, Cayton.”

This is in breach of “The Press must take care not to publish inaccurate, misleading or distorted information, including pictures” as areas being target under the new ban will not be the Royal Albert Drive and Sands End Road

  • The photo which looks inside a person’s home, be it temporary or permanent, is in breach of:

“Everyone is entitled to respect for his or her private and family life, home, health and correspondence, including digital communications.”

Following this case I would like to register a complaint against Lincolnshire Police for their actions at 00.30 on Saturday 3 May 2014 https://lincolnshireovernightparking.wordpress.com/2014/05/06/huttoft-car-terrace-notice-issued/ when I was rudely disturbed from my meditation. I am a Buddhist.

As I was conducting myself lawully as

  1. I have a permit
  2. My vehicle is below 1.9m
  3. I was not sleeping
  4. I did not leave my vehicle

the actions of Lincolnshire Police were in breach of the byelaw as per Part 4 – 7 (2).

If I receive an unreserved apology for their unlawful conduct within 5 working days I will seek no finanacial compensation from Lincolnshire Police or take any further action against them.

Huttoft Car Terrace – The Future

Last Friday Lincolnshire County Council (LCC) endured further humiliation as their wet behind the ears £1,500 per day barrister from London suffered defeat to a factory worker and painter & decorator.

He started by saying this was a “simple parking issue” and ended humiliated in conversation as to Alex taking salt and pepper on his food. If this was a simple parking issue why was no one from the multi million pound LCC legal department capable of dealing with it?

I was most impressed with Alex’s presentation in the court which I believe was twice as good as I could do. We are all very proud of Alex.

Crown Court Summary

  • Alex’s vehicle was below 1.9m
  • The judge ruled that prosecution for the May 11 ticket was an abuse of process
  • No evidence was provided to support the claim that Alex was asleep
  • The notices fixed to vehicles are fundamentally flawed to allow for prosecution
  • There was inadequate signage
  • Alex was awarded £669.69 costs
  • The case cost LCC an estimated £5,000 on the day

Conclusions

  • No one can be prosecuted who have received a notice on their vehicle
  • Unless LCC can establish adequate signage, which must be illuminated, LCC will be unable to prosecute anyone parking overnight at Huttoft Car Terrace.
  • So long as motorists remain with their vehicles anyone can lawfully park overnight on Huttoft Car Terrace.
  • Unless the byelaw is revoked and the remaining height barriers removed  both LCC and Lincolnshire Police are exposed to a legal challenge as per Part 4 – 7 (2) of the byelaw which states:

As both LCC and Lincolnshire Police are currently exposed to potential legal action I highly recommend that you revoke the byelaw and remove remaining height barriers at the earliest opportunity.

Please be aware that neither myself or any of my friends, which includes all motorhomers, will accept any further harassment from either LCC, Lincolnshire Police or any security company. If we are the victims of any harassment in breach of Part 4 – 7 (2) of the byelaw legal action will most certainly be considered.

Victory – Huttoft Car Terrace

One and a half years ago I received an email requesting my help. I met an amazing group of people who enjoy the simple pleasures of the Lincolnshire Coast. But for reasons unknown Lincolnshire County Council object to this and spent over £150,000 to prevent it.

This group contained Alex Sprott, who like myself, will never be intimidated by the state. LCC made the mistake of issuing a summons to Alex.

Today our karma has ripened, we took on the state and won.
